摘要
《劳动法》实施20年后的今天,我国正处于经济社会转型时期,劳动关系的主体及其利益诉求越来越多元化,劳动力市场也发生了复杂而深刻的变化,劳动关系矛盾已进入凸显期和多发期。在全面深化改革、全面依法治国的新的历史条件下,劳动法制建设面临着不容回避的问题:是继续制定单项劳动立法(如劳动条件基准法),还是全面修改《劳动法》。本文认为,《劳动法》的完善,仅仅通过单项劳动立法是无法实现的。
The PRC Labor Law has been carried out for 20 years.China now is in the economic and social transition period,the main body of labor relationship and its interest demand are more and more diversified,meanwhile,complex and profound changes have taken place in the labor market,the contradiction of labor relations is prone to be frequent and unexpected.Under new historical conditions that comprehensively deepen reforms and ruling by law is going on,Labor legislation faces unavoidable problems:keep on making individual labor legislation(such as Labor Standards Act) or comprehensively revising Labor Law?This article thinks that it is not enough to make a individual labor legislation to perfect the Labor Law.
