摘要
经济补偿金制度是一项有争议性的劳动法律制度,各国或地区经济补偿金制度可以类型化为法定义务型、法律责任型与社会保障型三种,与之相对应的法理根据为补偿、惩罚与保障。我国现行经济补偿金制度属于法定义务型,但其法理依据为生活保障。随着社会保障制度的发展完善,该项制度面临坚持、放弃还是改良的制度前景,需要重新审视其生成根据、适用前提以及适用范围,应当实行制度变换,改良经济补偿金制度,取消依法解除劳动合同的经济补偿金制度,将经济补偿金制度改造为违法解除的法定责任制度。
As a disputable legal system, severance payment systems in the world can be divided into three categories: compulsory obligation, legal liability, and social security. The corresponding legal bases of these three systems are compensation, punishment, and security. The current severance payment system in our country belongs to the type of compulsory obligation, but its basis is life security. With the development of social security system, the basis, application requirements and scope of the current severance payment system should be reviewed. Improvement should be made in the law. The severance payment should be modified into a legal liability when an employer terminates an employee illegally. If it is legal, there should be no severance payment.
