摘要
在校大学生在社会上兼职或打工已成为一种普遍现象,由此产生的在校大学生与用人单位之间的纠纷也层出不穷,各地法院的判决结果不一,对两者关系的定性没有形成统一的标准甚至出现了混乱的局面,司法实践中的各种难题不断浮出水面。本文以劳动者具有人格上的从属性和经济上的从属性两个特征为切入点,将兼职在校大学生进行分类定性,分别对狭义的"勤工助学"、实习、自行到校外兼职或者打工以及毕业前的"准就业"等不同情况进行了分析,并针对此类现象存在的问题和弊端,提出了法律层面上的设想与建议。
It has become a common phenomenon that college students do part-time jobs in our society, causing so many disputes between the part-time college students and enterprises, the results of people's courts differ from one another. The judicial practice are so mixed because we do not have an unifi ed standard to solve the hard problems. Based on the economic dependency and personal dependency of laborers' characteristics, part-time college students are divided into four categories,the narrow sense of work-study, internship, off-campus work by own decisions and 'employment' before graduation. The different situations are analyzed specifi cally in the paper. In addition, as for the existing problems and shortcomings of this phenomenon, I put forward the basic ideas and suggestions from legal level.
