摘要
不定时工作制已成为许多企事业单位采用的一种工时制度,但我国的劳动法规对"不定时工作制"概念缺乏统一定义,相关释义缺少细则,导致不同地区及各企事业单位施行不定时工作制存在"适用岗位、批准程序、劳动定额和工时标准、工作和休息时间安排、加班待遇和工资标准、年休假期待遇"等项事宜法规依据不足,实施标准的合理、合法尺度不易掌握等诸多问题。近年来,伴随申请单位剧增,引发行政诉讼或劳动争议案件亦呈加速增长态势。因此,规范不定时工作制概念和释义,将直接影响和有效保障劳动关系和谐发展。
Irregular working-hour system has become one of the working-hour systems to be used in many firms. However, National Labor Laws on the 'irregular working-hour system' concept are still lack of uniform definitions and interpretation of related details. As a result, items such as 'applicable positions, approval procedures, work quotas and labor standards, work and rest schedules, benefits and overtime wages and annual leaves' are facing problems such as lack of legal origin, inadequate implementation of reasonable standard, unclear applicable legal scale, and etc. In recent years, with the dramatic increase in the applications for irregular working-hour system has already led to a big growth in administrative litigation or labor disputes and related legal cases. Therefore, the specification and clear interpretation on the irregular working-hour system concept will have direct impacts on the implementation of effective labor protection as well as on harmonious development of labor relations.
