摘要
作为最基本、最重要的社会关系之一,劳动关系不只是劳动者和用人单位之间的双方经济关系,更是生产关系中的重要组成部分。伴随着互联网的发展以及"新常态""供给侧改革"等经济结构转型战略的提出,当前的经济发展模式和用工模式已悄然发生着深刻的变化,以Uber、滴滴打车等为代表的分享经济模式迅猛发展,对于传统的用工方式和社会保障制度提出了全新的挑战。本文通过全面剖析美国Uber案和解的情况,探讨了分享经济与传统劳动法律体系的冲突,并提出从制定独立承包人制度、改革社会保障体系以及创新行业自律和监管等角度出发。
As one of the most basic and important social relationships, the labor relationship is not only the transaction between the employee and the employer, but also the most important part of the relations of production. With the development of the Internet and concepts such as 'new normal' and 'reform of the supply front,' the present economic development and employment patterns are changing rapidly. The sharing economy as exemplif ied by Uber and Di Di is a brand new challenge for traditional employment and social security models. Against the background of the U.S. Uber case, this article, therefore, aims to investigate the conflict between the sharing economy and the traditional legal system and to offer advice on the independent contractor system, social security reform, current innovations for industry self-regulation and supervision,and what lessons can be learned from the U.S. experience.
