摘要
在我国劳动关系协调机制中,个别劳动关系的法律调整一直是立法的重点,《劳动合同法》对个别劳动关系的法律规范既约束用人单位的用工行为,也对目前企业选择用工行为有一定影响。本文对我国企业用工形式进行大致梳理,就劳动法对个别劳动关系适用的法律规范进行辨析,提出部分建议。
The legal regulation in the coordination mechanism of labor relations in China's individual labor relations is always the focus of the legislation,the employment behavior of the employer 'labor contract law' the legal norms of individual labor relations as constraints,also have a certain impact on the choice of enterprise employment behavior.In this paper,the form of enterprises in our country to sort out,on the labor law of individual labor relations applicable to the analysis of the legal norms,part of the recommendations.
