和谐劳动关系中的劳务派遣问题与对策——以湖州市国有企业为例 被引量:1

Problems and Countermeasures of Labor Dispatch in Harmonious Labor Relations——A case study of the State-owned enterprise in Huzhou City

摘要 劳务派遣相对于一般劳动关系而言是一种新型的劳动关系,作为一种灵活用工方式,本应该是对传统用工方式的补充,但由于国情的特殊性,劳务派遣迅速发展但被滥用。尽管《中华人民共和国劳动合同法》(以下简称《劳动合同法》)对此以"特别规定"的方式作了规定,还有其他专门性法律规制,但因现实中用人单位对相关立法的规避和曲解,再加上立法本身的缺陷,导致了劳务派遣领域的诸多问题,尤其是被派遣劳动者的权利被严重侵食。现实迫使立法机关不得不修法以查漏补缺,但仍未能从根本上扭转这种态势。我们应该纠正社会对"无固定期限"劳动合同的错误认知,强化劳务派遣的相关程序性机制,完善被派遣劳动者权利实现的程序性权利。 Labor dispatch is a new type of labor relations relative to the general labor relationship,as a way of flexible employment,but because of the particularity of the state of the union,labor dispatching quickly development and widely abused.Although the 'labor contract law of the People's Republic of China(hereinafter referred to as the' labor contract law ') in this paper are made in the form of 'special regulations' regulation,and other specialized legal regulation,but in realit,the employer evade and twist the relevant legistaltion,coupled with the lack of legislation itself,caused many problems in the field of labor dispatching,especially the right of dispatched laborers were seriously infringed.Reality forced the legislature to revise law to fill the vacancy,but still failed to reverse this trend fundamentally.We should correct the society 'non-fixed term labor contract' mistake cognition,strengthen the labor dispatch relevant procedural mechanism,perfect the dispatched laborers rights realization of procedural rights.
