随着我国经济社会的飞速发展以及社会结构的不断优化升级,新的生活需求带来新的就业增长点,家政服务行业呈现春意盎然的景象。但由于立法相对滞后,导致家政服务关系中的很多法律关系不明确,家政工人的权益得不到有效的法律保障。因此,我国必须先从立法角度维护家政工人的权益,确认家政工人的法律地位,并完善市场监管、保险、诉讼等救济路径保障其权利。

With the rapid development of China's economic and social as well as the social structure of continuously upgrading,new requirements of life bring new employment growth,domestic service industry present the scene of the awaken of spring is abundant.But as a result of legislation relatively lags behind,resulting in a lot of legal relationship in domestic service relations are not clear,the rights and interests of domestic workers cannot get effective legal protection.Therefore,China must safeguard the rights and interests of domestic workers from legislative Angle,to confirm the legal status of domestic workers,and perfect the market regulation,insurance,litigation relief path to protect their rights.
