摘要
学生伤害事故的妥善处理是减轻学校事故纠纷负担和经济负担的重要举措。但教育立法的目的更重要的是预防违法行为的发生。由于对《学生伤害事故处理办法》中关于“学校不承担监护职责”的规定存有误区 ,势必影响对学校伤害事故的防范。因而 ,有必要依据法理对有关误区进行分析 。
It is an important measure of lightening economic burden and disputable burden to correctly deal with school accidents.However,the more important purpose to legislate is to prevent illegal activities.Some people are misunderstanding the school guardianship to 'Regulation of Dealing with Student Accident', which exerts a negative influence on the prevention of the school accident.Further more,moving away from trouble of school accident and analyzing misunderstanding of school guardianship are needed.
