摘要
律师事务所管理评价体系具有执业行为效果的指引与预测功能;它基于公权力管控和团体自治的需要而生成,是公私法融合的结果;它的推行凸显了行政主体的多元化和行政方式的多样化。现阶段由司法行政机关主导推行评价体系具有现实正当性。构建并推行律师事务所管理评价体系的关键在于:一是评价标准体系应符合市场与律师行业的内在要求,二是评价的目标、过程、结果应与激励机制相连接。
The evaluation system of law firms management can be functional in direction and forecast of the practice effectiveness; Based on the necessity of power -control and association autonomy, it is an integrated result of public laws and civil laws.Furthermore, it highlights the fact of diversification of administrative subject and administrative mode.Currently, it is of realistic legitimacy for the judicial administrative authorities to dominate the implementation of evaluation system.The key issues to construct and implement management evaluation system of law firm are as follows: on the one hand, the evaluation standards should be in accordance with the internal demands of law practice; on the other hand, the goal, process and result of evaluation should be linked to incentives.
