由于国际民用航空跨越了国家边界并承载了来自不同国家的公民,一国政府对保障民用航空安全应积极履行国际义务。近期马来西亚航空公司MH17航班在乌克兰遭不明身份武装分子的导弹击落事件,将国际社会普遍关心的问题聚焦在国际民用航空安全的国家责任上。尽管国家责任引起的原因通常可归因于一国的国际不法行为,但由于国际民用航空安全所涉及国家责任的法律制度不完善和战乱情况下责任主体的确认存在困难,使得国家责任的履行往往要经历长期、艰难的过程。

Owing to the trans -boundaries among nations and carrying the citizens from different nations by International civil aviation, the government of one state shall fulfill the international obligations positively to guarantee the safety of civil aviation safety. Recently, the MH17 flight of Malaysia was shot down by unknown armed persons in Ukraine which led to the common concerns about the issue that the state responsibility in the field of international civil aviation safety by international community.In spite of the causes could be attributed to the international wrong acts by one state generally, while the existence of the insufficient legal system related to state responsibility and the difficult in determining the subject of responsibility under the circumstance of war in the field of international civil aviation safety which will make the performance of state responsibility experience a long and formidable process.
