养老机构老年人伤害预防处理机制研究

近年来机构养老在我国发展迅速,与此同时养老机构老年人的伤害问题也须引起高度重视。造成老年人伤害的原因多种多样,既有机构和护理员的问题,也有老年人自身的问题,还有来自社会的外界原因,这就造成了老年人伤害事件在法律责任认定上的复杂性,同时也影响到机构养老事业的发展。养老机构必须针对老年人伤害问题建立预防处理机制,从安全措施、预防处理方案、安全标准体系、纠纷处理机制、保险制度以及出台相关政策法规等方面加以落实,切实保障入住老年人的合法权益,降低养老机构的运营风险。

With the increasing problems of aging, pension institutions have developed rapidly in China in recent years. At the same time, the problems of the elderly getting hurt should be attracted great attentions. The reasons of elderly injuries are various, the institutions and the attendants, even the factors outside share the responsibility. It complicates the legal liability confirmation and impact the development of nursing institutions. Therefore, the pension institutions should establish the mechanism of preventive measures and implement works from the several aspects, such as safety measures, preventive measures, safety standard system, dispute settlement system, insurance system and relevant policies, in order to earnestly safeguard the legitimate rights of the elderly and reduce the operation risk of the pension institutions.
