正义作为家庭的优先性原则是现代家庭的重要标志之一,家庭正义既是当前家庭领域重要的理论问题,也是重要的实践问题。儒家家庭伦理要实现创新性发展需要对其一贯坚持的伦理正义进行创造性转化,这是儒家家庭伦理正义实现创新性发展的必然要求,也是应对当前家庭伦理困境的现实要求。儒家家庭伦理实现创造性转化需要以正义为优先准则,强调家庭成员的人格、尊严和价值的独立自由平等,确定儒家家庭伦理义务的界限性,扩展家庭伦理内涵的公共性。创新性发展需要转变儒家家庭伦理正义之价值思维,转变儒家家庭伦理正义之内容原则,厚植儒家家庭伦理正义之发展基础。

As the priority principle of family,justice is one of the important symbols of modern family.Family justice is not only an important theoretical issue in the family field,but also an important practical problem.In order to realize the innovative development of Confucian family ethics,we need to creatively transform the consistent ethical justice,which is the inevitable requirement for the innovative development of Confucian family ethical justice and the realistic requirement of coping with the dilemmas of current family ethics.To achieve creative transformation of Confucian family ethics,we need to take justice as the priority rule,which means emphasizing the independence,the freedom and the equality of family members’personality,dignity and value,and determining the boundary of Confucian family ethical obligation,and expanding the publicity of family ethics connotation.The innovative development needs to transform the value thinking of Confucian family ethical justice,and transform the content principle of Confucian family ethical justice,and enhance the development foundation of Confucian family ethical justice.
