校企合作立法中的责任主体及其驱动与规制——基于高等教育现代化视角的对策性研究 被引量:3

摘要 开放与法治是高等教育现代化的重要指标。破解我国职业教育校企合作困境、实现职业教育现代化的出路在于坚持教育开放的改革主方向,制定校企合作专门法。借鉴国际教育经验,立法要明晰立法主体、执法主体、产业主体、学术主体、教育主体等不同责任主体的主体责任,将其作为教育一致行为人纳入职业教育组织框架。进而,立法要确认新"双证制"教育评价机制和市场的利益驱动、规约机制。立法要对校企合作的方向、限制、过程、处罚进行条件性界定,建立不同法律位阶的制度保障框架。 Openness and legislation are the important indicators of the modernization of higher education.The way to solve the problems in college-enterprise cooperation and realize the modernization of vocational education is to adhere to the main direction of education reform and openness and make special law to promote college-enterprise cooperation.Drawing on the experience of international education,we should clarify the main responsibility of different responsible subjects such as the main body of legislation,the subject of law enforcement,the main body of the industry,the subject of the academic and the subject of education,and brought all these subjects the framework of the vocational education organization as the unanimous actor of education in the legislation.Furtherly,we should confirm the mechanism of new double certificate educational evaluation and the market interest driving and stipulating.The legislation should define the orientation,restriction,process and punishment of college-enterprise cooperation,and establish a system guarantee framework for different legal ranks.
