完善高校法人制度:“双一流”建设的法治保障

Improving the Corporate System of Public Higher Education Institutions: the Legal Guarantee for the National“Double First-rate”Strategic Plan

高校法人制度是"双一流"建设顺利推进的组织法律保障。与"双一流"建设的要求相比,我国高校法人的具体制度建设在章程实效性、法人财产自主权、法人组织机构制度等方面仍存在着不足,未来应将保障和促进高校的自主性作为制度完善的核心价值目标,在坚持高校学术自主性本位的同时防止其公共性危机的发生,并从章程、法人财产权、组织权力协调合作机制等方面着力完善。

The corporate system of public higher education institutions provides guarantee of organization law for the national'double first-rate'strategic plan.Comparing to the demand of the plan,there are problems in the corporate concrete systems of charter,property and organization.The autonomy of institutions should be guaranteed,which is the core value goal in the improvement of the corporate system in the future;and the institutions’academic autonomy should be the basic rule as well as the public crisis should be prevented.The system shoule be improved in the aspects of the charter,corporate property right,the power coordination and the collaboration mechanism.
