论冒充专利行为的犯罪化

On criminalization of impersonating patent

假冒专利与冒充专利是两个概念,前者可以构成犯罪,后者违反行政法规而不触犯刑法。冒充专利行为的社会危害性与假冒专利行为相当。我国立法机关在2008年修改《专利法》时重新界定了冒充专利行为的法律责任,明确规定冒充专利行为情节严重者可以追究刑事责任,但是其后的刑法修正案并没有对有关条款做出相应修改,致使专利法的立法本意未能贯彻落实。借鉴美国立法例,提出冒充专利行为犯罪化的必要性和实现路径。

Fake patent and impersonating patent are two concepts.The former can constitute a crime and the latter violates administrative regulations without violating criminal law.The social harmfulness of impersonating patent behavior is similar to that of fake patent behavior.In the amendment to the patent law in 2008,the Chinese legislature redefined the legal responsibility of impersonating apatent,clearly stipulating that those who impersonate a patent act seriously can pursue criminal responsibility.However,the subsequent amendment to the criminal law did not make corresponding modifications to the relevant provisions,thus failing to implement the legislative intent of the patent law.Drawing on the example of American legislation,this paper puts forward the necessity and realization path of criminalization of impersonation patent.
