On the socialization of family justice

家事司法社会化已经成为不同国家和地区家事司法改革的普遍趋势。在家事审判方式和工作机制改革试点过程中,我国法院开始了家事司法社会化的实践探索。我国家事司法社会化的理论基础在于保障裁判请求权,实现家事司法的价值与功能,体现家事司法专业化与社会化相兼容。我国家事司法社会化基本路径在于家事案件审判社会化、家事案件调解社会化、家事调查社会化和咨询服务社会化。

The socialization of family justice has become the general trend of family justice in different countries and regions.In the pilot process of reforming the family trial mode and working mechanism,China’s courts began to explore the practice of socialization of family justice.The theoretical basis of socialization of family justice in China lies in protection of rights of access to justice,realization of the value and function of family justice,and the compatibility between the specialization of family justice and the socialization of family justice.The basic path of family judicial socialization lies in the socialization of family trial,the socialization of family mediation,the socialization o family investigation and the socialization of consultation service.
