摘要
从法理分析和经济分析两方面考察,文章认为游客从旅行社安排的"购物点"购得假冒伪劣商品,旅行社应当向游客承担赔偿责任;游客若从旅游行程安排的景点内的购物场所购得假冒伪劣商品,旅行社应当积极协助游客请求商场退赔货款。
According to analysis of law and economics, a travel agency should undertake the compensation responsibility to the tourist if the tourist has bought the fake and shoddy merchandise from the shopping place which was pre-arranged by travel agency. If a tourist has bought the fake and shoddy merchandise from the shopping place in a scenic spot which was pre-arranged by a travel agency, the travel agency should assist the tourist to request the seller to pay back the price.
