刑事诉讼证明标准问题的研究无论是在诉讼理论中还是在司法实务中都具有重要意义。本文对我国传统的“客观真实”理论和新兴的“法律真实”理论进行解析、评论与反思 ,并提出我国要确立“客观真实”理念支撑下的“法律真实”的刑事证明标准。

The research of the criminal identification standard is important not only in the lawsuit theory but also in the real affair of administration of justice.This text is to proving on the foundation that the standard defines,the'objective true'theory traditional to our country and new developing 'law true' is analyzed,commented and reviewed,propose our country establish'law true'criminal identification standard under the supporting of 'objective true'theory at last.
