New Development of Theory of Proximate Connection on Tort

最密切联系理论自从在美国《第二次冲突法重述》中得到确立以来 ,对其他国家涉外侵权立法产生了重大影响 ,其价值判断却一直为各国理论及实务界所争论。法院在审理涉外侵权案件时 ,应在最密切联系理论的基础上 ,考虑侵权行为的社会价值和法律适用的实体结果 。

Theory of proximate connection exerts an important influence on tort legislation concerning foreign interests in other countries since it was founded in 'The Second Restatement of Conflict of Laws'in U.S.A.,but its judgement of value is always debated by circles of theory and practice.Trying cases of foreign tort,judge should consider social value of tort and substantive result of law application on the basis of theory of proximate connection in order to realize application of substantive law.
