试论交通肇事罪

On the Causing of Traffic Accident

交通肇事罪是指违反交通运输管理法规,因而发生重大交通事故,致人重伤、死亡或者使公私财产遭受重大损失的行为。但交通肇事后逃逸或者有其他特别恶劣情节,以及因交通肇事逃逸致人死亡的,则要加重处罚。在司法实践中,交通肇事后逃逸致人死亡的情形比较多,行为人主观上又多为故意,因此对行为人的行为应当以故意杀人罪定罪处罚,同时在处罚时也应将一般主体与特殊主体加以区别对待。

Crime of causing traffic accident is the act of violating regulations governing traffic and transportation and there by causing a serious accident, resulting in serious injuries, deaths or heavy losses of public or private property. But the one whoever runs away from the spot after he has caused a traffic accident shall be sentenced more heavily.
