摘要
雇佣犯罪是一种古老的犯罪形式,近年来频繁发生。通过对这一犯罪的特征、性质及实行过限问题进行详细的探讨,雇佣犯罪能否以教唆犯论,在司法实践中需要根据具体案情,作具体的分析,方能准确定罪量刑,打击雇佣犯罪。
The crime committed upon employment is an ancient form of offence however taken place frequently recently. By way of a thorough study on several issues concerning the crime, e.g., the characteristics and the nature of the crime, the issue of excess of execution, the author reaches the conclusion that whether or not the employer in such crime will be disciplined as abettor depends on different situations in specific cases. Only in this way can this kind of crime be punished properly and effectively.
