完善我国律师刑事辩护权的思考

Consideration oa Improving theRight of Criminal Defense of Counsel in China

我国刑事辩护权具有法定性、相对性、现实性和发展性等特点。获得刑事辩护权是现代社会的一项基本的人权,我国应该进一步完善律师的刑事辩护权。此外,还应建立律师转入司法机关的流动机制,建立健全律师管理监督制度,积极开展法律援助,设立公益律师等。

Right on criminal defense has characteristics of legality, relativity, realisticand development. Right of criminal defense is one of the basic human rights inmodern society. China should further complete the right of criminal defense of counsel. Furthermore, a system should be established for the attorney switching to judicial official, and attorney administration and supervision system as well.Legal aid should be positively practiced, and commonwealth attorney should be set up.
