摘要
我国物业管理法律制度中的自治管理机构应设计为 :物业区域内的业主组成一个非法人性质的社会团体—业主团体 ,业主委员会是业主团体的执行和代表机关。决策权应归属于权力机关 ,即通过召开业主大会或业主代表大会的形式以多数决规则对待决事项予以议决。决议形成之后的具体实施 ,则交由业主委员会完成。业主团体对外实施具体行为时以业主委员会的名义进行。
The autonomy management organization in the legal system of real property management of our country should be designed as:the owners of the real property in a region form a social organization of unincorporated society - the owners' organization,the owners'committee is the executive and representative organ of the owners' organization.The right to make policy should belong to the organ of power,that is to resove the matters awaiting solution by using the procedure of majority decision in the form of convening the owners' conference or the owner' representative conference.the concrete enforcement after the formation of resolution should be completed by the owner's committee.The owners' organization enforces the concrete actions in the name of the owners' committee.
