How to Set up a Working Procedure of Enforcement Judgment

构建执行裁判程序应遵循公正、公开、合法和合理的原则。执行裁判程序的核心内容是执行听证 制度。执行听证程序一般可分准备。调查、辩论、合议裁决四个阶段进行。执行裁判文书应以执 行裁定书形式表现。在强制执行立法中应考虑设置一个对执行裁判不服的救济途径。

We must obey to the principles of justice, openness, legality and rationality while setting up the procedure of enforcement judgment. The enforcement hearing system is the core of procedure of enforcement judgment. The enforcement hearing system is generally divided into four stages; preparation , investigation , court debate and collegia! ruling . The document of enforement judgment shoud be finalized as 'the document of ruling. As legislation for compulsory enforcement, I suggest to install a way of legal aids.
