摘要
行政处分是指行政主体对违反内部行政法律规范但尚未构成犯罪的内部相对人(主要是公务员),追究行政法律责任的一种内部具体行政行为。作为一种制裁手段和惩戒措施,它必然会对当事公务员的权益造成一定的损害,产生多方面的不利影响。为了防止行政处分权的滥用和保障公务员的合法权益,建立完善的行政处分救济制度是必要的。基于在检视行政处分救济理论变迁的基础上,从实际出发,对完善我国的行政处分救济制度提出若干建议。
Administrative disciplinary punishment is a kind of internal concrete administrative act which the administrative subject uses to run the legal responsibility of the opposite person to the administration (especially, the public functionary ) who didn' t break the criminal law but violated internal administrative law norms. As a punishing measure, it inevitably does some harm to the rights and interests of the public functionary involved. In order to prevent the power of administrative disciplinary punishment being abused and safeguard the public functionary's rights and interests under the law, it is necessary to establish a perfect remedying system for administrative disciplinary punishment. This essay tries to inspect the variance of the theories on the remedy for administrative disciplinary punishment and then practically puts forward some suggestions about how to consummate our administrative disciplinary punishment system.
