论网络隐私权的法律保护问题

On the problems in the protection of the network privacy by law

本文阐述了目前我国对于网络隐私权的法律保护中存在的问题 ,以及世界各国对网络隐私权保护的基本模式。最后提出我国对网络隐私权保护的制度设计 ,应借鉴欧、美等国经验 ,以国家制定法律的他律与网络行业自律相结合的方式 。

The present paper first gives an analysis to the current problems in China and some fundamental models adopted by most of countries in the world in the protection of the network privacy by law. Then, based on the lessons and the experience from foreign countries, it is suggested in the present article that the scheme of the network privacy protection in China should include the self-regulation and the rule by law.
