论我国司法审查制度与WTO协议的衔接

On the Linking-up of China's Judicial Review System and the WTO Agreements

入世后的中国,在对外贸易政策、其他国内政策和法律的制定以及政府的行为运作方面都要受到WTO规则的影响,即必须与WTO规则体系保持一致。司法审查在WTO法律框架中又居于重要地位。而中国现有的司法审查制度仍存在司法审查范围有限、司法审查标准内涵太窄等与WTO协议不相适应的地方。对此应采取建立完善司法审查依据、继续扩大司法审查范围、改革司法审查标准、加强审判专业化等措施,以确立与WTO协议相适应的司法审查制度。

After China enter the WTO, the enactment of its foreign trade policy, domestic policies laws and regulations, and the governmental operation are all affected by the WTO regulations, that is, they must be in conformity with the WTO system. While the judicial review system is one of the important issues in the WTO legal framework, there are still some problems existing in the current judicial review system in China, e.g. the judicial review scope is limited, the standard for judicial review is too narrow. In order to establish an appropriate judicial review system in China, we need to adopt the methods of establishing and perfecting the judicial review basis; continuously expanding the judicial review scope; reforming the judicial review standard and strengthening the professionalism of the trial group.
