法律的文化解释这一进路在学界引起赞誉的同时也引发了不少批判。应当对该进路的内涵进行充分挖掘和细致梳理,并将得出的结论运用于对我国法治现代化建设的某些现实问题的探讨。以这种运用为基础,还可以对该研究进路做出另一种解读,比如,反思某些批判该进路的观点,指出该进路适用的场域、它的优势,以及在运用其进行研究时要注意的问题。

Recognizing the cultural interpretation of law as an approach of study arises both praise and criticism.The connotation of the approach should be elaborated and classified,and the conclusion on this discussion can be applied to specific issues in reality when considering some practical problems in the modernization of law in China.Based on this application,an alternative interpretation of the research approach can be made,for instance,reviewing some critiques of the approach,pointing out the applicable field and its advantages,as well as remind us of some of the issues to be aware of when conducting research on that.
