在中国古代刑法史研究领域,鞭刑是一个引人注目的课题,而在蒙古汗国时期,鞭刑使用更有自身许多独特之处,但迄今为止,对大蒙古国时期的鞭刑研究甚少。因而本文拟从实证的角度出发,结合相关资料,来探讨这一时期的鞭刑发展、变化、适用、刑罚特点等方面,以期揭示鞭刑在当时法律中的地位和影响。

Ancient Chinese History of the whip penalty is a remarkable subject in the field of the criminal law history.There are many unique of the whip punishment,especially in the Yeke Mongghol Ulus period.But so far,the largest study of Yeke Mongghol Ulus period which the whip penalty less.Thus this paper from the empirical point of view,with relevant information,to explore this period of the whip punishment,change in applicable penalties,and other characteristics,with a view to reveal the whip punishment at the time of the legal status and influence.
