摘要
集体经营性建设用地入市试点是整个集体建设用地改革中的一个关键环节。从本世纪初开始实行的城乡建设用地挂钩试点,到2015年开始实行的农村土地征收、集体经营性建设用地入市、宅基地制度改革试点,到2017年开始实行的集体建设用地租赁住房建设试点,再到2018年开始探索的宅基地"三权分置",彰显了中央对农业农村优先发展中集体建设用地改革的坚定决心,但改革之路仍面临诸多利益关系的协调和风险矛盾的化解。中央政府应在试点地区统一实施专项财政转移支付,构建区别于国有土地入市的特殊的税费政策,实施特殊的官员绩效评价机制。
The pilot project of collective construction land entering the market is a key link in the reform of collective construction land.From the beginning of this century,the pilot project of linking urban and rural construction land began to be implemented.The pilot project of land expropriation,collective construction land entering the market and the reform of homestead began to be implemented in 2015.The pilot project of rental housing construction of collective construction land began to be implemented in 2017.The'separation of three rights'of homestead began to be explored in 2018.All these measures demonstrate the central government’s strong determination to reform collective construction land under the policy of giving priority to agriculture and rural areas,but here the reform also means the coordination of many interests and resolution of risk contradictions.The central government should unify the implementation of special financial transfer payments,establish the special tax and fee policy that are different from those of the state-owned land entering market,and implement a special performance evaluation mechanism for the officials in the'pilot areas'.
