论民间法的象征意义

On the Meaning of Symbolic of Customary Laws

民间法是人类特定群体中的自生自发性规则,它们在形成层面的精神性指向表达出其象征意义。而在民间法的运行层面,这种象征性意义也会表现在对个案的纠纷处理当中。针对这一现象,理论界应当借此研究规范的精神意义、法律与仪式的关系并挖掘民间法的内涵。实务界则应当借此在立法上划分国家法和民间法的界限,而在司法上,司法主体应在法定职责范围内对待民间法的象征意义,并且应运用理性的程序规则实现民间法象征意义的合理运作。

Customary laws are spontaneous rules in given human beings’ groups.They express their symbolic meanings because of spiritual direction in the aspect of formation.In the aspect of operation of customary laws,the symbolic meanings will be shown in dissolving concrete cases.Pointing at this phenomenon,theoretical circles should research spiritual meaning of rules,the relationship between laws and ceremonies and excavate connotation of customary laws in this way.And practical circles should divide boundaries between legislations on state and customary laws in legislation.The judge should take the symbolic meanings of customary laws seriously within the scope of duties in judical field and use proper procedural rules to make symbolic meanings of customary laws operate in a reasonable way.
