新乡贤与乡村用法力量的系统提升——以江苏省丰县梁寨镇为例

The New Elites’ of Villager and the Benign Enhance on Rural Power of Using Law:the Case from Town of Liang Zhai at Feng xian County in Jiangsu Province

根据用法行为针对的社会关系或事务,可将现代法治社会的用法行为主要分为四类,即纯私人性用法行为、国家公务性用法行为、社会公务性用法行为、私人公益性用法行为,并可以相应地分出四类用法主体或力量。新乡贤的制度性出场,可以为乡村用法力量的良性成长带来诸多积极的影响。它可以促进乡村社会公务性用法力量整体上向乡村自身的内生性力量发展,并形成一支社会认同性高、法律素质和运用技能较高的村民用法队伍;同时,它还对村民私人公益性用法和纯私人性用法的良性发展有积极提升作用。这并不仅仅是理论上的论证,而是可由梁寨镇新乡贤现实作用给予一定印证的法治实践创新。

According to the behavior of using law on social relationships or transactions,the behavior in the modern society mainly can be divided into four categories,namely pure personal behavior of using law,national business behavior of using law,social public behavior of using law,private nonprofit behavior of using law,and correspondingly gives four types of law body.The new elites of villages′Institutional appearance,can bring a lot of positive impact on the growth of benign for rural power of using law.It can promote itself to rural development endogenous forces of civil society on the whole rural power using law,and the formation of a high social identity,and the use of high quality legal skills in the use of the villagers team;at the same time,it also has a positive role in upgrading villagers for private pure nonprofit using law and healthy development of private using law.This is not just a theoretical argument,but a proof of new legal innovation practices by the quality and behaviors of new elites′of villager coming from the town of Liang Zhai in Feng County.
