论民间规范与地方立法间的关系——以湖南文化立法为例

On the Relationship between Folk Norms and Local Legislation——Taking Hunan Cultural Legislation as an Example

民间规范对于完善地方立法有着不可估量的意义和价值。民间规范与地方立法之间既存在着内在的契合性,同时亦存在着一定程度的矛盾和冲突。基于民间规范与地方立法之间的契合性有效化解它们二者之间的矛盾冲突,充分利用民间规范,就能够最大限度地实现地方立法的科学性,湖南的地方文化立法实践就有力地说明了这一点。

Folk norms have immeasurable significance and value in perfecting local legislation.There is inherent agreement between folk norms and local legislation,and there is also a certain degree of contradictions and conflicts.Based on the agreement between folk norms and local legislation to effectively resolve the conflict between the two,and make full use of the folk norms,the scientific nature of the local legislation can be realized to the greatest extent.The practice of the local cultural legislation in Hunan illustrates this point forcefully.
