设区的市地方立法趋同化探讨

A Study on the Similar of Local Legislation

《立法法》修改后,地方立法主体急剧扩容,地方性法规数量急速增长,设区的市地方立法在立法条例和实质性法规等方面呈现出趋同化态势。在这一新形势下,地方立法趋同化与地方立法重复的实质性差别愈发凸显,设区的市地方立法趋同化也随即成了应该被予以认真对待的新问题。不同于法律趋同化思想的全球视野,地方立法趋同化局限于统一的民族国家,其形成原因可以从地方立法政绩化误区以及立法权限界定不明确等主客观方面进行思考和分析。针对设区的市地方立法趋同化在实践中可能会造成的立法资源浪费、法制不统一等危害,端正立法观念、明确立法权限、组建立法队伍、统筹整合立法以及进行联合立法是应有的规制之道。

After the revision of the legislative law,the number of the local legislative subjects and laws are increasing dramatically,and the local legislation showed a trend of similarity in the legislative and substantive statutes.In this new situation,the differences between the repeated of local legislation and the similar of local legislation are becoming prominent.So the similar of local legislation has been a new problem that should be taken seriously.Different from the legal similarity idea of global vision,the similar of local legislation limits to the United Nation.Its causes can be traced back to the subjective aspects,for example,local legislative achievements of misunderstanding.And objective aspects,for example,the legislative authority is not clearly define.In practice,The similar of local legislation may waste of resources or cause the legal system not be unified.It should be the ways of regulation,such as,correcting the legislation idea,defining legislation authority,setting up legislation team,and making the legislation conformed and cooperation.
