罗马法与伊斯兰法婚姻制度之比较——从《婚姻法》在我国民族地区的实施效果透视

Comparing the Institution of Marriage Between Roman and Islamic Law: In Perspective of the Implementation of Marriage Law at Ethnic Areas

罗马法与伊斯兰法婚姻制度在婚姻观念、婚姻原则、婚姻程序、夫妻财产关系等诸多方面各有异同,前者开启了近现代各国以及我国现行婚姻制度之先河,而后者对我国信仰伊斯兰教的诸少数民族影响深远。在多元文化并存的社会背景下,继受于大陆法系的我国现行婚姻法与深受伊斯兰法影响的少数民族婚姻习惯在婚姻原则、婚姻程序以及夫妻财产关系等方面存有较大冲突,致使国家婚姻法在民族地区之权威性遭受挑战。因而,从渊源上梳理和总结罗马法与伊斯兰法婚姻制度之基本精神,不仅有助于不同法系之间的交流与沟通,而且对促进我国现行婚姻法在民族地区的适用与认同,实现国家民事制定法与少数民族婚姻习惯之间之良性互动具有重要的实践价值。

There are many differences between Roman law and Islamic law on the marriage institution in terms of concept,principle,procedures,marital property relations etc.the former law has established marriage institution of China and modern countries,while the later law has far-reaching influence to ethnic area where people are Muslims.With the multicultural social background,huge conflicts would be produced between our current Marriage Law in civil law and Islamic Law which was influenced by ethnic habit in terms of principle,procedures,marital property relations,etc.,thus the authority of national Marriage law in the ethnic areas would be challenged either.Therefore,combing and summarizing the basic spirit of marriage institution between Roman law and Islamic law originally,it would not only help the exchange and communication between different legal systems,but also provide with a crucial practical value for promoting the Marriage Law’s application and recognition at ethnic areas,so as to achieve fine interaction among National Civil Law and Ethnic marriage habits.
