'世界结构'被认为是使中国问题发生变化乃至中国人甚或中国法律哲学认识问题的方式发生变化的历史性条件,世界结构中的中国法律哲学的实质在于主体性,在于形成一种世界结构下的中国观,并以这种中国观主动参与世界结构的重构。这意味着在中国法治在坚持主体性的同时,要积极参与世界对话,防止陷入盲目拥抱西方价值和盲目拥抱本土价值两种极端倾向的悲剧。
