摘要
行政先行处理程序是我国行政赔偿程序中的一个重要的组成部分 ,由于赔偿立法的不完善 ,行政先行处理程序在实施过程中还有较多不足。从行政先行处理程序的理论基础出发 ,分析我国行政先行处理程序的立法缺陷 。
The procedure of administrative deal first is one of the important part of the procedure of administrative compensation. The implementation of the procedure of administrative deal first has many deficiencies because of the faultiness of the legislation of compensation. This article researches the basis of compensative theory,put forward some suggestions of the legislation of administrative compensation.
