Judicial Impartiality and the Public Participation:On the Theoretical Analysis of the Jury System

基于保障司法民主和公正的需要 ,现代刑事诉讼制度十分重视普通公民对诉讼的参与 ,陪审制度即是诉讼参与原则的具体表现。本文从考察司法公正与群众参与的关系出发 ,分析了陪审制度产生的理论基础和诉讼价值 ,阐述了陪审制度及参与原则在我国刑事诉讼制度中贯彻实施的现状和不足 。

In the modern criminal litigation system, much attention has been paid to average citizens’ participation in litigation so as to safeguard the judicial democracy and impartiality. However, Jury system embodies the principle of litigation participation. The paper begins with the relations between judicial impartiality and the public participation, analyzing the theoretical basis and litigation value of the formation of the jury system. Then illustrates the present condition and deficiencies of the jury system and the principle of participation in practice. Finally comes up with some suggestions as for perfecting our jury system.
