先秦时期军事伦理与军事法制发展关系探要

A Probe on the Developmental Relations between Military Ethics and Martial Legal Systems in the Period of Pre-Qin

在先秦时期中国军事法制从秘密走向公开、从零散走向集中、从不成文走向成文的发展过程中,古代中国早期的军事伦理思想起到了不容忽视的作用。从法制实践活动所体现的总体精神或指导思想来看,先秦军事法制反映着军事伦理领域从神伦到人伦的思想变迁轨迹;从法律文本所体现的法制规范内容来看,先秦军事法制也受到了日趋精致的军事伦理思想的影响而不断充实。

In the period of Pre-Qin, the Chinese Martial legal system moved from mystery to publicity, from separation to concentration, from unwritten laws to written laws. Hence the military ethic thoughts in the early ancient China played an indispensable role. By the general spirits or guiding concepts expressed in the legal practices, the martial legal systems in the Pre-Qin reflected the changing trace of thoughts from holy ethics to human ethics in the field of military ethics; by the standard contents of the legal system reflected in the legal documents, the martial legal systems in the Pre-Qin were also influenced and gradually improved by the increasingly perfect military ethics.
