人格权平等的法人类学关怀——对马林诺夫斯基思想的另一种言说

LEGAL ANTHROPOLOGICAL CARING ON THE EQUALITY OF PERSONALITY RIGHT:A DIFFERENT INTERPRETATION ON MALINOWSKI'S THOUGHT

人类学家马林诺夫斯基具有传奇色彩的学术经历,由其所开创的现代法人类学田野调查方法逐渐得到后世学者的重视和呼应,但是很少人着墨去关注马氏人类学思想中的人格权平等观念,亦即用法人类学的维度来解读他本人及其经典著述。马林诺夫斯基对人性尊严的关注不仅体现了人类学研究的内在本旨,同时也诠释了平等之法律价值。据此,从所有人类属性之人格权平等视角来厘析马林诺夫斯基早期人类学中平等价值主题的哲学伦理,实乃为全球不断复苏的后民族主义、种族主义、民粹主义以及相延伸的民族恐怖主义治理提供了一剂良方。

The legendary academic experience of an anthropologist, Malinowski and the fieldwork method of modern legal anthropology he created were attached its due importance by later scholars gradually,but few people paid attention to the concept of the equality of personality right in his anthropological thought which is to interpret himself and his classic works from the perspective of legal anthropology. Malinowski's caring about human dignity not only implied the essence of anthropological study, but illustrated the legal value of equality as well. Therefore, the analysis on Malinowski's early philosophical ethics of the value of equality from the aspect of the equality of personality right provided a good solution for post-nationalism,racialism,populism,and national terrorism which are reviving globally.
