建立我国空间建设用地使用权制度若干问题的探讨

Probe into Several Questions about Establishing the Institution of the Right to the Use of the Constructive Site in the Space of China

我国《物权法 (征求意见稿 )》借鉴其他国家立法例 ,在“建设用地使用权”一章中规定了“空间建设用地使用权”。但是 ,有关该项权利的概念、性质、目的 ,以及应当采取何种立法例建立该项权利等问题 ,存在较大争议。有必要认真探讨 ,以使该项制度的建立既能反映时代潮流 ,又能切合中国实际。

The Jus Rerem (proposed draft) of China has taken the legislation of other countries for reference to provide for 'the right to the use of the constructive site in space' in the chapter of 'the right to the use of the constructive site'. However, there are controversies on the concept, nature, purposes of the right, and what kind of legislation shall be used to establish such right. It's necessary to probe it seriously to make the establishment of the institution to reflect trend of the age, and be fit in the reality of China.
