平等与自治是民法和合同法的基本原则 ,从法律关系的性质来看 ,目前物业管理活动中存在着三大问题 ,即 :主体地位不平等、权利义务不对等、管理行为不规范。应从体制改革。

Equality and autonomy are the basic principles of the Civil Law and the Contract Law. Through expounding the character of legal relation and connecting the reality, this thesis analyzes three primary problems existing in the recent realty management, that is, inequal status of subjects, asymmetrical rights and obligation and unstandardized management movement. Bases on the above discussion, this thesis finally provides the resolution in three aspects:structural reform, social environment for rule by law and management concept.
