The Criterion of Procedual Justice

程序公正虽然在理论界、司法界已有所重视,但人们对程序公正的标准认识不一。文章认为程序公正应包括:法官中立和被立、当事人平等、程序的充分参与、程序公开及追求诉讼效率等内容。

Although the theoretical and judicial circles have attached great importance to the procedual justice, there don' t hold identical views. This article thinks procedual justice should involve the neutrality and independence of judge, party equality, procedual participation, procedural opening and in pursuit of procedural efficiency.
