19世纪英国思想家约翰·密尔的《论思想和论辩的自由》,被誉为"英语世界里最经典的关于新闻自由的辩护词"。他的思想也成为美国大众传播法的法理依据。然而,密尔的新闻思想有着功利主义和自由主义的双重理论基础。所谓的"思想市场"只体现了他的消极自由观念,我们还应注意到其"社会责任"这一积极自由观念。
The famous paper On Liberty of Thought and Discussion written by John Mill, the great British thinker in the 19th century, was regarded as 'the most classical defenses of freedom in the English language'. Mill's thoughts have been the jurisprudence foundation of the American Mass Communication Law. However, utilitarianism and liberalism both were the foundation of his thoughts. The 'Market of Ideas' theory reflected his negative-liberty side. We should note that his 'social responsibility' theory also reflect his positive-liberty side.
