摘要
我国高等教育的快速发展要求在理论上和立法上对于校生关系作出更清晰、更准确的界定。本文总结了国外关于校生关系的几种理论学说,指出了我国立法和司法实践中对于校生关系认定的特点、差异及各自的缺陷,并提出了校生关系的性质及立法上对之应持有的态度。
The rapid development of higher education in C hi na requires the exact defining to the relation between universities and their st udents on the basis of theory and legislation.The thesis summarizes several the ories on the problem abroad,and examines the features of,differences between and respective defects of the present Chinese statutes a nd judicial practice on the relation defining,and proposes the proper way the la w should adopt to deal with the problem.
