Simple Remark on the Basic Principle of Civil Action

民事诉讼基本原则是民事诉讼基本理论的重要组成部分,是指由民事诉讼法价值、目的、构造所决定的,体现了民事诉讼当中,对民事诉讼活动的进行起指导作用的基本原理和基本规则。应包括:法院审理原则;以事实为依据,以法律为准绳原则;平等原则;辩论原则;调解原则;处分原则。

The basic principle of civil action is an important composed part of the basic theory of civil action. It is determined by the value, aim and structure of civil procedure act; meanwhile, in the course of civil action, it embodies the basic principle and rule that plays the directing part to the civil action and should include: court trying principle; the principle of taking the law as criterion and the fact as ground; the principle of equality; the principle of mediation and the principle of punishment.
