上海城市管理综合执法体制改革及进一步改进的对策 被引量:4

The System of Integrated Law Enforcement in Shanghai's Urban Administration Its Transformation and Improvement

摘要 行政执法是国家行政机关贯彻有关法律、法规,进行经济、社会事务管理的基本形式,行政执法体制的构建对于提高管理效率、规范执法行为具有直接的决定性作用。从20世纪90年代中后期开始,一场探索新型的行政执法体制的改革在我国数十个大中城市先后展开,目前,新体制已经释放出巨大的管理效应,对各地城市管理水平的提高产生了积极的推动作用。本文以上海为个案,回顾了城市管理综合执法体制改革产生的背景、基本内容、基本经验和存在问题,对进一步改进和完善城市管理综合执法体制提出了对策建议。 Administrative law enforcement is the basic form of the governmental activity in managing the economic-social affairs. Reconstructing the system of law enforcement plays a critical role in improving the government efficiency and standardizing the executive behaviors. From the middle-and-later period of the 1990s, directed by Council of State, an institutional reform of exploring completely new system of law enforcement, which is called System of Integrated Law Enforcement (SILE), outspreads in over 70 middle and big cities in China. In the field of city management, the power of administrative penalties that are controlled and imposed by several administrative organs in the past two decades is relatively integrated into one organ. Now the new system has brought great managing effects and has become the new dynamics of increasing the level of urban management. Taking Shanghai as an example, the paper retrospects the emerging background of SILE, introduces its main content, and analyzes fundamental experiences and existing problems. Moreover, the paper gives some constructive suggestions about further pushing forward the transformation of administrative law enforcement system.
