论刑事自诉案件的若干问题

SOME PROBLEMS OF PRIVATE PROSECATION IN CRIMINAL PROCEDURE

本文简要叙述了刑事自诉案件在一些地区大幅度增长的情况,指出正确处理这类案件的重要意义;着重分析了刑事自诉案件的性质及其特点,阐述了审判此类案件的一般程序问题,并对刑事自诉案件中的证据问题,附带民事诉讼问题,代理人、辩护人问题等,从理论与实践的结合上,进行比较系统地分析,以求正确理解和执行法律。

Noting the rapid increase of criminal private prosecution cases in some regions,this article points out the importance of dealing with such cases properly.It analyses the nature and characteristics of criminal private prosecution cases and so forth the general procedure in their judicial judgement.combining theory and practice,it attempts to reach a correct under standing and enforcement of law through a systematic analysis of such problems as evidence, supplementary civil action in criminal proceedings,agents and defenders in these cases.
