滑坡论及其在法律推理中的应用

On the Slippery Slope Arguments and the Application in the Legal Reasoning

作为一种实质法律推理的方法 ,滑坡论在我国是一个全新的概念。本文参考国外理论研究成果 ,首先介绍了滑坡论的基本理论。然后阐述了滑坡论的逻辑性质 ,深入分析了影响其论证效力的诸多因素。在此基础上 ,分析指出由于判例 (案例 )在司法裁判中的作用、模糊法律概念的存在、法官的内心倾向及社会舆论的影响等 ,使得在法律领域 ,尤其是司法领域极易出现滑坡 ,应用滑坡论可以为法官拒绝作出某种判决提供充分有力的理由 ,促使法官认真严谨地制作判决书 。

As a method of substantive legal reasoning, slippery slope argument is a completely new concept in our country. With reference to foreign studies results, this thesis introduces the basic theories and logic features of slippery slope argument and analyses the factors influencing its effectiveness. Then the author analyzes and points out that, owing to the functions of cases in judicial judgment, indeterminate legal terms, judges psychological inclination, social opinions and etc, slippery slopes are easy to come out in judicial fields, therefore, slippery slope arguments can provide judges with strong reasons in resisting certain decisions and make them write the verdicts carefully and cautiously so that the decision today would not lead to undesirable consequence in the future.
